1. PARTIES & ACCEPTANCE
   Using the Service — including having software you deploy call the API —
   accepts these Terms. Under UETA / E-SIGN electronic-agent rules, deploying an
   agent = the principal's acceptance; each request and payment binds you.

2. SERVICE DESCRIPTION — INFORMATIONAL ONLY
   OrcaTrace sells Polymarket prediction-market intelligence: a unified signal
   feed (quality-gated market repricings with order-book microstructure,
   tracked-whale entries annotated with hold-to-resolution calibration, and
   AI-detected predetermined-outcome markets), a 4-hourly Intelligence Digest,
   a verifiable free whale track record, markets-resolving-soon analysis, and
   on-demand single-market deep research. Output is aggregated, computed, and in
   part LLM-synthesized from public and third-party sources and is for
   information only — it is NOT investment, financial, trading, betting, legal,
   or business advice. Whale calibration measures ENTRIES held to resolution,
   not trader profit-and-loss (exits are not tracked). Do not rely on any output
   as the sole basis for any decision.

3. DATA SOURCES & FRESHNESS
   Underlying data is derived from Polymarket and other public/third-party
   sources. Feed items carry a createdAt provenance timestamp; the Intelligence
   Digest reflects the most recent 4-hourly synthesis and is not served when
   stale (the paid digest route returns 503 rather than stale data). Resolving,
   whales, and research responses are computed on demand from live sources. All
   data may be incomplete, delayed, revised, or stale. Market end dates are
   event-level, Polymarket-scheduled, and occasionally revised. OrcaTrace does
   not warrant the completeness or accuracy of any data.

4. PAYMENT TERMS
   Paid endpoints are priced per call in USD and settled as USDC via x402 on
   Base Mainnet (eip155:8453). Current per-call prices are published
   machine-readably at https://api.orcatrace.dev/discovery and https://api.orcatrace.dev/openapi.json (the
   binding source of truth for prices) — no price table is duplicated here, to
   avoid drift. The free endpoints require no payment. The database-read paid
   routes are compute-first / settle-after: you are NOT charged for an error.
   Taxes and network fees are the buyer's. No bundles, no subscriptions, no API
   keys.

5. REFUND POLICY — GUARANTEE ON THE PROXIED-COMPUTE ROUTES
   The database-read paid routes settle only after the answer is computed, so a
   charge-without-delivery should not occur. The three proxied-compute routes
   (markets resolving soon; whale calibration table; single-market research)
   settle EARLY — the payment is charged before the compute backend runs — and
   carry a GUARANTEE: if OrcaTrace charged you but could not deliver a
   successful result (the compute backend was unavailable, returned an error, or
   the response could not be delivered), the payment is automatically refunded.
   Refunds are enqueued at the time of failure and issued from an off-edge
   settlement process. Otherwise all sales are final.

6. PRIVACY
   Request parameters (e.g. market slug, lookback window, resolution horizon)
   are processed to produce the response and are not linked to a person. Payment
   settlement facts (payer address, tx hash) may be logged for accounting and
   refund reconciliation. OrcaTrace does not collect owner, registrant, or
   end-user personal data. Whale wallet addresses shown in the track record and
   whale routes are public on-chain identifiers, not personal data of yours.

7. ACCEPTABLE USE
   No unlawful use. No circumventing rate limits or payment. Free endpoints are
   rate-limited; abusive traffic may be throttled or blocked. Underlying
   third-party data (Polymarket and others) remains subject to the source
   providers' own terms.

8. AS-IS / NO WARRANTY
   Service and data provided "AS IS" / "AS AVAILABLE", with no warranties of any
   kind. Data may be delayed, wrong, incomplete, or stale. No uptime, latency, or
   continuity guarantee; no SLA.

9. LIMITATION OF LIABILITY
   No liability for indirect, incidental, or consequential damages, or for
   decisions made in reliance on the Service. Total liability capped at fees paid
   to OrcaTrace in the prior 30 days.

10. GOVERNING LAW & DISPUTES
    Governed by the laws of the operator's country of establishment (Poland) and
    applicable EU law; disputes before the competent courts there, subject to
    mandatory consumer-protection rights.

11. CHANGES TO TERMS
    We may update these Terms; the version/effective date and canonical URL will
    be revised. Continued use after changes = acceptance.
